Private Enforcement in the EU

ICC launched the ICC Task Force on Private Enforcement in the EU in 2006 to feed business views in key EU consultations on competition enforcement in the private sector.

The most recent work of this task force includes comments to the European Commission on collective redress, advocating the implementation of strong safeguards against abusive claims, and the adoption of a coherent approach both in terms of competition and consumer protection.

The task force has also addressed the role of fines in effective competition enforcement, condemning anticompetitive behavior and supporting the appropriate, objective, and proportionate enforcement of competition laws that focus on fostering compliance, and not just punishment and deterrence.

It is important to note that ICC has been active on the issue of private enforcement in the EU long before creating a dedicated task force and has developed several position papers, a list of which is provided below.

To develop its policy work, the ICC Task Force on Private Enforcement in the EU regularly collaborates with other ICC commissions including the Commission on Commercial Law and Practice and ICC ADR (Amicable Dispute Resolution).

The task force is chaired by François Brunet, Partner at Cleary Gottlieb Steen & Hamilton.
