Promoting and Protecting Intellectual Property in Turkey is a 2011 BASCAP and ICC Turkey report that outlines the value of IP in Turkey and offers comprehensive policy and legislative recommendations to advance the state's IPR regime.

 





The intangible nature of intellectual property lends itself vulnerable to theft. IP theft, as evidenced by the global proliferation of counterfeit and pirate products, drains economies of revenue and jobs and puts downward pressure on innovation, international trade and investment. As a result, strong IP protection goes hand-in-hand with government policies to encourage investment in IP and the realization of the significant benefits of IP to a country's growth and development.

Value of IP in Turkey

Section one of the BASCAP report explores the benefits of IP protection for the Turkish economy. Intellectual property rights (IPR) generate substantial economic activity, employment and growth. BASCAP assesses that enhancing IPR has the potential to attract foreign direct investment (FDI) and promote R&D and technology transfer.

Section two describes the risks associated with IP theft and their impact on the Turkish economy. Turkey is the second-largest counterfeit product market in the world and 58% of consumers in Turkey admit to regularly purchasing illicit products. Counterfeiting and piracy in Turkey is an estimated US$5.7 to $9.6 billion industry. The magnitude of the problem is a significant drain on tax revenues and hurts employment and FDI.

Key legislative and policy recommendations

Turkey has taken concrete actions to enhance its IPR regime by enacting better legislation; increasing the number of raids, arrests and prosecutions for IP crime; establishing specialized IPR courts; increasing public awareness; and participating in initiatives for international cooperation. These steps have met with tangible results, but challenges remain.


Improvements in legislation encompass a wide range of recommendations to address deficiencies and ambiguities in criminal IP law and procedures that are relevant to police enforcement, the court room, at the border and on the internet. Additionally enhancing international cooperation and fully implementing international IP treaties will contribute to a robust IPR regime.


Policy recommendations include various measures, actions and initiatives aimed at supporting the implementation and enforcement of IP legislation, interagency cooperation and raising public awareness.
