    Comments on the Draft Third Amendment of the Patent Law in China dated December 27, 2006

    The International Chamber of Commerce (ICC) is pleased to present the following comments on the draft Third Amendment of China’s Patent Law dated December 27, 2006.

    The draft Third amendment, when implemented, would improve the patent statute in many ways and bring the Law a significant step closer to internationally accepted standards. At the same time, there remain concerns and questions with some of the proposed changes in the present draft Third Amendment. ICC has provided detailed comments on a number of articles in which it has concerns and hopes to receive further clarification. ICC submission also includes a proposal for the LAOSC to consider the addition of two new article (Articles 27-1 and 40-1) in its next draft of the Third Amendment.
