ICC conference features arbitration in Latin America in a couple of weeks

The conference has become a vital tool for arbitration professionals

ICCis holding its 8th annual Miami conference on International Commercial Arbitration in Latin America: The ICC Perspective on 7-9 November. Practicing lawyers, corporate counsel, arbitrators, and academics will be among the experts participating in the event.

The conference has become a vital tool for arbitration professionals who need to keep up with the ins and outs of regional differences in arbitration, as well as the latest developments in this rapidly-evolving field. Attendance at the conference has grown annually and the participation this year is expected to surpass last year’s attendance of 300. The popularity of the conference is not only attracting more participants but also sponsors. Squire Sanders & Dempsey and Pinheiro Neto are among the 15 sponsors this year.

Over the past five years ICC has received 3,193 requests for arbitration from all over the world. Of the 8,499 parties involved in cases filed with the ICC International Court of Arbitration, almost 12% come from Latin America and the Caribbean. Regional arbitration has also been marked not only by the increasing number of cases, but also by their complexity. 

“The ICC annual conference on International Commercial Arbitration in Latin Americareflects ICC’s undisputed experience on the subject. The conference provides practitioners the benefit of an insider’s perspective offered by a highly experience panel and the opportunity to understand and find ways to address relevant issues,” said Jose Feris, ICC International Court of Arbitration Counsel.

The conference will analyze several arbitral awards relating to the oil and gas industry. Expert panellists will investigate whether common notions and practices applied to this industry are based on prior arbitral decisions and what conclusions, if any, can be drawn from the use of arbitration for the future.

Conference speaker Horacio Grigera Naon an independent arbitrator, said:“International arbitration is booming in Latin America to say the least. In this regard, the ICC Miami conference is a good opportunity to discuss the oil and gas, and the construction sectors from a Latin American perspective.”

During the conference the impact that constitutional recourses may have on international arbitrations involving Latin American parties will also be examined. In particular speakers and participants will analyze to what extent recourses of Amparo – and other similar recourses based on fundamental and constitutional rights – were designed to deal with, or are applicable to, international arbitration.

These are just some of the many topics that will be discussed during the two-day event conducted in English and Spanish with simultaneous interpretation.

The interactive and informal ICC meeting for young arbitrators will also take place on 7 November. A debate on arbitrating for and against states will be featured.
