How do I become a member of a Dispute Board?
The ICC does not work with a roster. There is therefore no such thing as an ICC list of arbitrators, neutrals or experts. Pursuant to the ICC Rules for Arbitration, when the ICC Court has to appoint an arbitrator it has to request a proposal from one of the ICC National Committees. The ICC Rules for Expertise and the ICC ADR Rules do not provide for this requirement. In accordance with these latter rules, ICC appoints experts and neutrals either through an ICC National Committee or otherwise. When nominating these persons ICC is therefore free to appoint any person having the characteristics required by the parties.
This being said, it should be noted that ICC has an updated database of possible candidates, which also includes information about the performance of arbitrators, neutrals and experts who have acted in previous cases.
The same principle will be applied for the DB Rules. When ICC will be invited to appoint a DB member, it will take into account the parties' requirements. Furthermore, ICC will have to take into account, in accordance with Article 7(8) of the DB Rules, the "DB Member's qualifications relevant to the circumstances, availability, nationality and relevant language skills".
