Appointment by ICC

Pursuant to Article 3 of the ADR Rules, the parties may either jointly designate a Neutral or request ICC to act as appointing authority.

Finding the right Neutral for your case

ICC does not appoint Neutrals from a closed list, and there is no list of certified “ICC Neutrals, Mediators, Conciliators, etc.”

ICC makes an individual search through ICC National Committees and the ICC global network to appoint a Neutral having the specific qualifications that have been agreed upon by all of the parties.

Screening Process

ICC requires every prospective Neutral to provide a curriculum vitae and to conduct a thorough conflict check. If independent, the Neutral must sign a statement of independence and must disclose to ICC any facts or circumstances which might be of such a nature as to call into question his or her independence in the eyes of the parties.

Moreover, all Neutrals selected by ICC must demonstrate extensive training and experience in the applicable dispute settlement technique as well as solid skills in facilitating cross cultural negotiations.

Flexibility

Upon agreement of all of the parties, they may request ICC to appoint more than one Neutral.
