Costs of ADR
The cost of an ICC ADR proceeding consists of the registration fee, the Neutral’s fees and expenses and administrative expenses (see the Appendix to the ADR Rules).
- Non-refundable Filing Fee: US$ 1 500, case will not proceed until filing fee is paid.
- No set table for Neutral fees.
- The Neutral’s fees are set at an hourly rate in US$ by ICC after consultation with the Neutral and the parties.
- The hourly rate shall be a reasonable amount which, on a case to case basis, can vary depending on experience of Neutral, complexity of dispute and local market conditions
- The Neutral’s expenses shall be fixed by ICC on the basis of ICC's practice note on reimbursement of expenses. They must be reasonable and must be justified by receipts.
- Administrative fees are not linked to the amount in dispute.
- Administrative fees range from US$ 1 500 up to maximum US$ 10 000, and depend on the amount of work conducted by the ADR Secretariat.
- ICC does not pay value added taxes (VAT) or other taxes or charges applicable to the Neutral’s fees.
- Parties have a duty to pay any such taxes or charges, but the recovery of any such taxes or charges is a matter solely between the Neutral and the parties
