Enforceability of ADR Settlement Agreements
Settlement agreements stemming from ADR proceedings are not enforceable
under an international treaty like arbitral awards under the New York
Convention.
Settlement agreements are binding agreements that may be enforced, if necessary, through subsequent arbitral or state court proceedings.
However, one of the reasons why ADR is an attractive dispute resolution option is that enforcement is generally not a concern as parties overwhelmingly perform voluntarily.
