Other Settlement Techniques

The parties can choose different settlement techniques other than mediation.

Whilst mediation is the principal and default settlement technique, the ICC Mediation Rules are inherent flexible and allow parties to choose a different settlement technique other than mediation if they consider it better suited to their needs including:

  • conciliation,
  • neutral evaluation,
  • mini-trial and
  • a variety of combinations of these and other techniques.

If parties have agreed upon a settlement technique other than mediation, the term ‘mediator’ will be deemed to cover the neutral who conducts the chosen settlement procedure (Article 1(3)).
