This advanced level training is aimed at legal practitioners who have extensive experience of international commercial arbitration. Participants will study the arbitration procedures through the simulation of a complex mock case.

Study of a complex mock case under the 2012 ICC Rules of Arbitration

Drawn on the experience of renowned arbitrators in a multicultural and international environment, this advanced-level training provides and in-depth understanding and first-hand experience of the ICC Arbitration procedure under the 2012 ICC Rules of Arbitration


Objective

By using a practical case-study approach and role-plays to address a series of situations that arise during complex arbitral proceedings, you will gain the expertise and competence to prepare for an arbitral proceeding under the new ICC rules: from drafting the request, to preparing the witnesses, to enforcing the final award.

Who is it for

This programme will benefit practising lawyers, corporate counsel, arbitrators, magistrates, academics, dispute resolution experts and users who have a strong experience of international commercial arbitration, in particular of the ICC procedure, and who wish to deepen their practical knowledge and share their views with international practitioners.

Working methods

  • Study of an advanced and complex mock case under the 2012 ICC Rules of Arbitration in small working groups. The mock case will be sent to participants before the training so that they can read the facts and identify the contractual issues which cover the events mentioned in the facts.
  • Technical and practical presentations by international ICC Arbitration experts.
  • Debate amongst participants and speakers during the interactive plenary sessions.

Morning sessions:

  • Organization of the seminar and summary of the mock case
  • Positioning of ICC Arbitration
  • Setting up of Claimant's strategy in preparing the Request for Arbitration: analysis of the different procedural options and dispute resolution methods (including the Emergency Arbitrator); parties' identification, selection of claims, measures and relieves

Afternoon sessions:

  • Working Groups on Claimant's strategy
  • Reports from the working groups and discussion on Claimant's strategy

  • Complex arbitrations: issues of multiparty arbitration, multi-contract arbitration, joinder of third parties; parallel proceedings and consolidation of matters; jurisdictional objections
  • Working groups: setting up of the Respondent's strategy for the Answer to the Request
  • Plenary session: reports from the working groups and discussion on Respondent's strategy

Afternoon sessions:

  • Conducting complex proceedings:
    (i) managing complex situations: issues of procedural meetings, benefits of the case management conference, difficulties in the drafting of the Terms of Reference and the Procedural Timetable; bifurcation of proceedings; resolution of procedural incidents; organization of the hearings; (ii) managing relations with local courts; relations between Arbitral Tribunals and National Courts; arbitrability of the dispute; request for interim measures; actions before local courts
  • Conflict of interest and challenges of arbitrators

Cancellation policy

50% of the registration fee will be refunded if notice of cancellation is received in writing before 2 November 2012. Cancellations after this date are not refundable. Subject to agreement from ICC Training and Conferences prior to the event, the registration may be transferred to another person from the same company or organization at no extra charge.
