The conference, held in Portuguese and Spanish without simultaneous translation, will give young arbitrators the opportunity to exchange thoughts on international arbitration and to enrich their network in the region.

First Roundtable: Pre-arbitral stage: Defining a collaborative relationship between in house counsel and outside counsel

• Is it worth it? Early case management - Definition of matters with low chances of success.
• To document or not to document? Relevance and impact of pre arbitral settlement negotiation minutes during the arbitration.
• It takes two to tango: What to look and ask for in order to find an ideal outside counsel.

Second Roundtable: During the arbitration: Establishing a tailor made and cost effective procedure

• The role of in house counsel tailoring the arbitral procedure.
  • When to reach agreements on applicable procedures.
  • When to ask for a dispute to be decided based on documents only.
  • Case Management Conference and Terms of Reference Hearing.
• Maintaining realistic schedules. Making appropriate financial planning.
• Keeping the eyes on the prize: Whether or not to settle.
  • Awareness of settlement procedures: mediation, neutral evaluation and others.
  • Correct reassessment of the case depending on the current state of the proceedings.
