Focus on ADR
The horizons of dispute resolution are widening worldwide. Alongside litigation and arbitration, other methods of settling conflicts are increasingly being used in the business world, such as mediation, negotiation, mini-trials and neutral evaluation.
ICC has addressed this evolving situation by launching in 2001 a new set of rules specifically designed to offer an institutional framework for conducting a wide range of amicable dispute resolution procedures.
The 2001 Special Supplement to the ICC International Court of Arbitration Bulletin includes a presentation and analysis of this new ICC dispute resolution service by Peter Wolrich, leader of the Working Party responsible for drafting the new ICC ADR Rules.
ADR - International Applications also contains a selection of articles by specialists in various parts of the world, who describe the practice of ADR in their respective countries and regions. These studies focus on Australia, China, France, Indonesia, Malaysia, the USA and South American countries and highlight the issues facing ADR proponents and practitioners in these various countries, where ADR is at different stages of development.
Contents - ICC ADR Rules: The Latest Addition to ICC's Dispute Resolution Services (Peter M. Wolrich); ICC Conciliation: A Glimpse into History (Steuart Hamilton); Selected Perspectives on ADR in Asia (Louise Barrington, Karen Mills & Tan Swee Im); Australian ADR and the Issue of Judicial Discretion (Laurence Boulle); Alternative Methods of Dispute Resolution in Latin America (Diana C. Droulers); Mediation and French Law: Recent Landmarks in Legislation and Case Law (Alexis Mourre); ADR in the United States of America (David W. Plant); Appendix: ADR Rules of the International Chamber of Commerce.
ADR - International Applications, ICC Publication No. 640, is available in separate English and French editions and is distributed as part of the 2001 subscription to the ICC International Court of Arbitration Bulletin.
