The specific features of dispute resolutions in international construction contracts, particularly in Turkey and the Middle East, will be the subject of conference co-organized by ICC and the International Federation of Consulting Engineers (FIDIC).
The conference, which will take place in Istanbul 15-16 October, will look at the specifics of ICC arbitration in construction disputes, notably cases involving state or para-state entities, and multiparty and multi-contract issues.
International construction disputes have for many years represented a significant portion of the disputes submitted to the ICC International Court of Arbitration. In 2008, 15.7% of cases submitted to the Court were construction related.
“The ICC values its relationship with FIDIC and looks forward to working with the federation to make this conference a success,” said Jason Fry, Secretary General, ICC Court of Arbitration.
“Participants will learn about the practical problems encountered in enforcing arbitral awards and will discuss the impact of the current financial crisis on international construction disputes in Turkey, the Gulf and the Middle East, all important centres for construction and engineering projects,” Mr Fry added.
Those attending will be presented with the FIDIC contract forms used in public contracts and the new Multilateral Development Banks’ Harmonized Construction Contract (MDB Contract) as well as the other major FIDIC forms.
Special attention will also be given to dispute boards, through extensive discussions on the advantages and disadvantages of Dispute Adjudication Boards (DAB), on the comparison between the FIDIC and the ICC Dispute Board Rules and on the qualifications of DAB members. A panel will feature a mock case illustrating to the audience how issues are dealt with and solved by a Dispute Board.
Engineers, contractors, in-house lawyers from construction companies, arbitrators and mediators, contract managers and financial institutions should have a special interest in attending the seminar.
