Ad Hoc Group on Drafting Arbitral Awards Co-Chaired by Maître Marco Darmon (France) and Judge Humphrey Lloyd (United Kingdom).
Following the decision of the Commission on Arbitrationat its meeting held on the 26th of May 2005, the article entitled “Drafting Awards in ICC Arbitrations”, written by the members of the Ad Hoc Group: Humphrey Lloyd, Marco Darmon, Jean-Pierre Ancel, Lord Dervaird, Christoph Liebscher & Herman Verbist, has been published in the ICC International Court of Arbitration Bulletin, vol. 16 / No.2 – Fall 2005.
The article aims to guide new arbitrators through the exercise of writing an arbitral award and was constructed with input and comments from Members of the Commission on Arbitration and ICC National Committees, in an attempt to pool the best practices of veteran ICC arbitrators. The article does not purport to serve as a set of rules for arbitrators, given the very varied practices and legal traditions of the countries in which ICC awards are rendered and must be upheld.
The article will also serve as a frame of reference for more experienced arbitrators who wish to gain insight into best practices of their colleagues in drafting arbitral awards.
