ICC to host US conference on construction contracts

The conference on international construction contracts will offer the latest methods to resolve construction disputes swiftly and cost effectively.

As construction projects have grown more complex, disputes have been on the rise, costing US firms upwards of $5 billion a year in litigation fees. Given that successfully resolving disputes now has a major impact on the bottom line in the large but  ailing US construction industry, the ICC/International Federation of Consulting Engineers (FIDIC) conference on international construction contracts in Houston from 2 to 4 June will offer the latest methods to resolve construction disputes swiftly and cost effectively.

Engineers, contractors, employers, arbitrators and legal advisors will gather to learn how to handle disputes over international construction contracts in a timely and efficient manner.

“With the number of disputes submitted to the ICC International Court of Arbitration rising significantly each year, the demand and the importance of such a conference is self evident. The US market is terribly important and we hope that we will attract a significant number of participants from the US, as well as elsewhere. The conference will give participants a closer look into how to resolve such disputes in a timely and a more cost-efficient manner under the ICC Rules of Arbitration and Dispute Board Rules,” said Jason Fry, Secretary General of the ICC International Court of Arbitration

The conference will delve into the following issues, focusing on an American lawyers’ perspective:

• Reviews of multi-tier dispute resolution procedures under the FIDIC contract

• The new FIDIC Design-Build-Operate (DBO) contract

• The role of the expert in international construction disputes

• Dispute Boards

• Arbitration with state parties

World-renowned experts on international arbitration and the construction industry will lead sessions and be on hand to encourage discussion among participants.

ICC plays an important role in resolving international construction disputes. Last year the number of cases filed with the ICC International Court of Arbitration totaled 559, a figure unprecedented in the Court’s 85-year history. FIDIC Conditions of Contract are the most widely used standard forms of contract in international construction.
