As the demand for mediation continues to grow worldwide as an effective means to settle commercial disputes, ICC Publications has released a new book entitled, We Must Talk Because We Can: Mediating International Intellectual Property Disputes, by David W. Plant.

Mr Plant, a renowned author and published practitioner of mediation, is also the author of a previous ICC volume, Resolving International Intellectual Property Disputes.

In We Must Talk Because We Can, Mr Plant details how the parties involved can prepare and engage in IP mediation in the most productive manner.

“If only parties will talk openly and empathetically, often they will find they can create a mutually satisfactory solution – even against the backdrop of a troubled and dysfunctional history,” Mr Plant writes. “There is all the more need for well-designed IP mediation in this flat, globally connected world.”

The role of the mediator is fundamental to a successful outcome of the dispute. Mr Plant defines the role of each party in mediation, and offers concrete measures to obtain the most satisfactory results.

The book also explains the critical issues in mediation, including which IP disputes are suitable for mediation, creating value through the mediation process, and barriers.
