Selection by the parties
Pursuant to
Article 3 of the ADR Rules, the parties may either jointly designate a Neutral
or request ICC to act as appointing authority.
Screening Process
Where all of the parties have jointly designate a Neutral, ICC shall request the jointly designated Neutral to provide ICC with his or her curriculum vitae and to conduct a thorough conflict check. If independent, the Neutral must sign a statement of independence and must disclose to ICC any facts or circumstances which might be of such a nature as to call into question his or her independence in the eyes of the parties.
Appointment by ICC, if necessary
Where the designated Neutral does not agree to serve or Neutral has not been designated by all of the parties, ICC shall promptly appoint a Neutral.
Flexibility
Upon agreement of all the parties, the parties may designate more than one Neutral.
