Costs & payment

The 2015 ICC Dispute Rules provide for the compensation of the Dispute Board members and ICC.

Dispute Boards Members’ Fees and Expenses

All fees and expenses of the Dispute Boards (DB) Members are shared equally by the parties. The DB members’ fees are fixed by agreement of the parties and the DB members in the DB Member Agreement. Unless otherwise agreed by the parties, the DB members are treated equally and receive the same Monthly Retainer Fee and the same Daily Fee for their work as DB members (Article 26). 

Monthly Retainer Fee (Article 27) 

This fee covers the following: 

Unless otherwise agreed by the parties, the Monthly Retainer Fee shall be equal to three times the Daily Fee and shall be payable from the date of signature of the DB Member Agreement until its termination. 

Daily Fee (Article 28) 

This fee covers the time spent for the following activities: 

Travel Costs and other Expenses (Article 29) 

Taxes and Charges (Article 30) 

Administrative Expenses of the ICC International Centre for ADR 

ICC charges administrative expenses for each of the following services: 

Appointment of each DB member 

Each request for the appointment of a DB member must be accompanied by a payment of US$5,000 per DB member to be appointed. This payment is non-refundable and represents the total cost for the appointment of one DB member by the ICC DB Centre. The cost of each appointment by the Centre is shared equally by the parties unless otherwise agreed. 

Decision upon a challenge of a DB member 

Each request for a decision upon a challenge of a DB member must be accompanied by a registration fee of US$5,000. This is non-refundable and will be credited to ICC’s administrative expenses for a decision upon a challenge, which are fixed by the Centre in an amount not exceeding the maximum sum of US$10,000. The cost of each decision upon a challenge is borne by the party filing the challenge. 

Review of a DAB or CDB Decision as to form 

Each DAB or CDB Decision submitted to ICC for review pursuant to Article 23 must be accompanied by a registration fee of US$5,000. This is non-refundable and will be credited to ICC’s administrative expenses for the review of the Decision, which are fixed by the Centre in an amount not exceeding the maximum sum of US$10,000. The cost of reviewing a Decision is shared equally by the parties unless otherwise agreed. 

Request to fix the fees of the DB Members 

Each request for the Centre to fix the fees of the DB Members must be accompanied by a filing fee of US$5,000. The filing fee is non-refundable. No request for the Centre to fix the fees of the DB Members shall be processed unless accompanied by the requisite payment.
