Expectation, reality and the road ahead: weighing in on expedited arbitration process

Since its inception, expedited arbitration has gained a favorable response and is widely implemented by parties and arbitral institutions. Many agree that expedited arbitration is a time and cost-efficient solution for parties when resolving disputes of much lesser value and complexity. This is not always the case as there are complex and big value disputes that are also referred to expedited arbitration. This demonstrates that there are circumstances when expedited arbitration does not commensurate with the size and value of disputes, and vice versa. In this session, the speakers will examine the feasibility of expedited arbitration.

Discussion

12.45 – 14.15

Lunch

14.15 – 15.30

Putting the pieces of the puzzle together: jurisdictional scopes of the arbitral tribunal and domestic courts over related multiple claims

The intricacies of related multi-party and/or multi-contract arbitrations never cease to be a relevant and inviting topic. Often, related multiple claims are simultaneously submitted before arbitral tribunals and domestic courts even when there are clear arbitration agreements in place. This causes different procedural orders and decisions made by two different bodies which affect the final execution of such decisions. The speakers will navigate the different jurisdictional scopes of arbitral tribunals and domestic courts when dealing with related multiple claims, and how these transpire in practice particularly within contract-based commercial arbitration context and occasionally within investor-state arbitration context.
