The practice of documentary evidence in international arbitration is rapidly changing. The ICC Institute of World Business Law has chosen this topic as the theme for its annual meeting, which will take place on 24 November in Paris.
“Arbitrators are increasingly confronted with new challenges, such as requests for the production of electronically stored documentation,” said Alexis Mourre, Partner, Castaldi Mourre & Partners, France and Council Member of the Institute of World Business Law. “In addition, the growing volume of document productions poses a challenge to the efficiency of the arbitration process.
“Increasingly, arbitrators confront difficult issues such as fraud and forgery, and objections are becoming more and more frequent as to confidentiality and privilege. This conference aims to foster the debate on the proper balance between the parties’ right to present their case and the business need for reducing time and costs,” Mr Mourre added.
The one-day conference will also deal with possible evolutions of arbitral practice in the field, as reflected by the current International Bar Association works for the revision of the rules on the taking of evidence.
The conference will be conducted in English and French with simultaneous translation. One of the aims of this annual event is to create doctrine, the result of which is compiled in an annual ICC publication entitled Dossiers of the Institute.
